Abstract: In A Theory of Justice John Rawls claims that the principles of justice which he proposes “... are equivalent ... to an undertaking to regard the distribution of natural abilities as a collective asset ...\" This view has been criticized by a number of writers who argue that it either leads to a violation of important personal freedoms or else commits Rawls to a conception of the person which is incoherent. In this paper, I focus on the version of this critique of Rawls presented by David Gauthier in Morals by Agreement, and try to show that it relies on some untenable assumptions. I argue that the Rawlsian discussion of individual assets and entitlements provides a legitimate and credible framework from which to address questions of justice.
